These workshops are open to all ILWU Longshore Members covered by the ILWU/BCMEA Collective Agreement and is recommended for anyone who holds Union office, anyone who is a designated worker representative, or anyone newly elected or interested in running for Union office.

Week 1 – Just Cause:

This workshop reviews the steps involved in employee discipline from a workplace incident and employer investigation to BCMEA discipline and through the grievance process to arbitration. We will discuss strategies for dealing with BCMEA and employers under the industry agreement. Facilitated by Craig Bavis.

Week 2 – Post-Incident Investigations:

In this workshop, we examine post-incident investigations under the industry Drug and Alcohol Policy including: What makes an incident a significant event, what is a reasonable line of inquiry to suspect impairment, what is the role of the Union representative and what are the member’s rights? Facilitated by Rebecca Kantwerg.

Week 3 – Internal Affairs:

The Union’s constitution is the rule book that the members wrote to run the Union. This workshop explains the rights that a member individually has, the authority of the general membership, and the powers delegated to officers and committees. We will review the processes for fair elections, rule making, member discipline, and fair despatch as required by the courts and the Canada Labour Code requires. Facilitated by Satkaran Sandhu.

Week 4 – Privacy Primer:

Unions have an obligation to members to keep their personal information private and a duty to provide information about how the Local operates under the Privacy legislation. This workshop explains when the Local must disclose information and when it must refuse to release member information, including in member trial proceedings. Facilitated by Liam McClure.

Week 5 – Union Liability:

Last year, ILWU Local 8 in Portland was assessed a $93 million fine for an illegal work slowdown. This workshop identifies the potential liability that comes with Union actions. We will review the legal claims that members, causals, and employers can make against a Local for job actions, human rights breaches, and the duty of fair representation. Facilitated by Jeff Sanders
